The government is going to submit to the State Duma a bill that will revive the preventive measure in the form of prohibiting the operation of a vehicle. Moreover, traffic police inspectors will be able to make such a ban right on the road. We explain how all this will work and how it threatens the drivers.

What's happening

Now, as such, there is no ban on operation in Russia, although until November 2014 there was one: cars that cannot appear on public roads (for example, faulty or without OSAGO) were removed from the license plate. They could be returned only after repairs or the purchase of a policy. But there are more complexes for photo and video recording of violations than traffic police inspectors, and they are useless without numbers on cars. Therefore, the removal of registration plates was abolished, leaving only fines.

Now they decided to return the ban on exploitation, but in a new way. According to the amendments to the law on road safety developed by the Ministry of Internal Affairs, the operation of cars in Russia will be prohibited in the presence of malfunctions or other conditions that pose a threat to road safety. For such machines, the diagnostic card will be suspended first, and then the registration certificate will be canceled if the defects are not corrected.

What specific malfunctions and conditions will be considered to pose a threat is not yet fully understood. All of them will be listed in an updated list that the government is preparing. It should include, for example, a ban on driving on summer tires in winter and on studded tires in summer. Updating the list of faults implies additional clarifications, as well as links to the technical regulations of the Customs Union, and not to outdated GOSTs.

The regulations currently in force prohibit the use of vehicles with steering play in excess of 10 degrees, with increased exhaust emissions, or without head restraints when designed.

It is also forbidden to drive a car, the design of which has not been approved by the traffic police. For example, additional lighting equipment is installed, which is not intended by the manufacturer, or wheels that are too large (or too small). Moreover, now all such improvements must not only be agreed upon, but also entered into the electronic register.

Why can the diagnostic card be suspended?

Having identified a malfunction (for example, tires out of season or inoperative headlights), the inspector will draw up a protocol on the prohibition of operation and suspend the diagnostic card. And the driver will have three days to fix the defects.

During this time, it will be necessary not only to eliminate the malfunction, but also to undergo an extraordinary technical inspection, during which only the node or component due to which the ban was issued will be checked. Naturally, you will have to pay for such an inspection yourself. As soon as a new diagnostic card appears in the EAISTO information system, the ban on operation will be lifted.

It is also assumed that the diagnostic card will not always be suspended. For example, if the driver himself changes a burned-out light bulb on the spot, he will be released without harsh sanctions.

However, in some situations there is a risk of being left not only without a diagnostic card, but also without a car. For example, when the driver cannot go to the place of troubleshooting, or if his wipers do not work in bad weather, or the headlights do not turn on at night.

You will not be able to drive if the brakes, steering or towing hitch are faulty. In this situation, the car is delayed and sent to the impound.

For what can the STS be withdrawn

If, after three days, a new diagnostic card does not appear in the EAISTO information system, and the car again falls on the road to a traffic police officer, then the vehicle registration certificate will be withdrawn. Accordingly, in such a situation, further movement is possible only on a tow truck.

How to return documents?

To return the certificate, you will need to fix the malfunction, take the car on a tow truck to the inspection point, issue a diagnostic card and only then go to the traffic police.

For which they can cancel the diagnostic card or withdraw the STS now

Currently, no one except the court can cancel or suspend the validity of the diagnostic card. And only the insurance company has the right to go to court on this matter - if the accident happened due to a malfunction of the car and there is evidence that the car did not pass the inspection. And this will most likely be done in order to refuse payment due to the use of a forged document in the registration of insurance.

The traffic police will have the right to cancel diagnostic cards from March 1, when amendments to the law on technical inspection come into force. The grounds are the same: issuing a diagnostic card for a vehicle that has not been diagnosed.

The traffic police will have the right to suspend the operation of the diagnostic card due to the ban on operation a year after the amendments to the law on road safety are adopted by the State Duma, approved by the Federation Council, signed by the president and published.

The STS can now be withdrawn only if the document is on the wanted list or there are signs of forgery on it. The STS is on the wanted list, as a rule, due to the suspension of the registration of the car by the previous owner or due to the cancellation of the registration.

A car can be canceled, for example, if changes were made to the design of the car without registration with the traffic police. Also, registration is terminated if the traffic police receives information about the death of the owner of the car.
