Buying a used car comes with risks. And hidden accidents, twisted odometer or unit malfunctions are not the most serious of them. Today, you can run into scammers who sell a car that is pledged to a bank or other organization.

What is the problem?

The fact that it is simply impossible to sell such a car like that. Collateral objects are sold according to special procedures and not to individuals. This means that sooner or later the transaction will be declared illegal, and the holder of the pledge will take the purchased car from you on official grounds. The money paid for it will also be difficult to return, especially if the fraudulent seller is gone. Therefore, before buying a car, you should definitely check for collateral and credit.


And what's the difference between them?

Credit - that is, a car for the purchase of which the bank issued a special loan (car loan) - is only in use by the buyer. Until the full payment of the loan, the car legally belongs to the bank. It is the bank that is inscribed in the vehicle title (and at the same time - in the CASCO policy, which is mandatory for credit cars) as the owner, and the document itself is stored there. And only after the loan is closed, the vehicle is reissued to the one who bought it. With the corresponding entries in the TCP. But scammers manage to sell credit machines without waiting for this moment.

Collateral is a little more complicated. In addition to car loans, there are other forms of loans in the financial market in which the car becomes the subject of collateral. A bank or other credit institution is happy to accept a car as a guarantee of the return of the issued funds as the most liquid and expensive property of the owner. At the same time, the car itself is left to the owner and allowed to use it, taking only the original PTS. And no entries are made in it, which means that fraudsters have room for maneuver.


How to understand that a car can be pledged?

The first thing to do, and even before starting the inspection of the car, require the seller to show the original TCP. Since such a pledged car is stored with seven seals in a credit institution, they will try to slip a copy of it, or even just a fake, under various plausible pretexts (I forgot, I'm afraid of losing, etc.). Great care should be taken with the duplicate title issued to replace the lost one (allegedly). It may turn out that in fact the first copy is not lost at all, but lies in the bank.


What else gives out scammers

In addition to the dubious PTS or its copy, you should be alerted by other oddities:

  • The price of the car is noticeably lower than the market price, indicating the seller's desire to get rid of it as soon as possible.
  • Too short a period since the previous transaction on the car, especially if this fact explains the absence of records about it in the TCP. A credit car can be specially “resold”, hiding the traces of fraud.
  • Information in the TCP that the previous transaction was carried out under a commission agreement, that is, with the involvement of a third party (organization) - an intermediary between the owner and the buyer. Such a scheme may have a completely harmless explanation (selling a car through a car dealership), but often it is fraudsters who use commission transactions to cover their tracks and evade responsibility.

  • Lack of documents for the purchase of a car by the current owner of the vehicle. Indeed, the purchase and sale agreement could indicate that the purchased car is pledged. Do not be surprised: under certain conditions, you can also sell a mortgage car. Moreover, there are offices engaged in the mass purchase of such vehicles (in this case, its price is much lower than the market price).

How to check that the car is not pledged?

In any case, a used car should be checked for a deposit, even if, at first glance, everything is fine with the documents. This can be done for free or by paying a certain amount of money.

The fastest and easiest check out of the free ones - on the traffic police website… The department receives information about the restrictions on registration actions imposed on the car (and the deposit is among them), which can be viewed by entering the VIN number of the car on this page.

However, in practice, such a check does not give a 100% guarantee. First of all, fraudsters try, first of all, to "legalize" the car in the eyes of law enforcement officers. Secondly, relatively quickly, only the restrictions of other fiscal authorities reach the traffic police, and private property collisions are registered in the last turn.

You can also check the deposit by VIN for free on the website of the Federal Notary Chamber of Russia… Since 2014, the department has been keeping a register of notifications on the pledge of movable property, you can get access to it here. To proceed to the check, select on this page the item "By information about the subject of the pledge", then "Vehicle" and in the form that appears, enter the VIN-code.

Any notary can “break through” the VIN you are interested in using the same database, and in the absence of collateral, issue a certified extract from the register. This is your insurance for the future: if information about the collateral appears after the purchase (and this happens), the certificate will prove that you are a bona fide buyer. The cost of the service is 100 rubles.

However, do not flatter yourself. According to insiders, information about the pledged property of the banks into this database is merged, albeit en masse, but by no means mandatory. Therefore, even a "clean" car history does not guarantee the absence of problems in the future.

A large and up-to-date credit and collateral information base is also available for National Bureau of Credit Histories (NBKI). Unfortunately, an ordinary car buyer has no access to it: these data are entered by banks for other banks and are considered private. Only legal entities accredited with the Central Bank have the right to work with the database, so only an employee of the corresponding department of the credit institution can detect the collateral. And an individual, upon request, finds out only his own credit history.

Only when inspecting such a car, it is imperative to check the real VIN with the one indicated in the ad by the seller.
